Pursuant to Articles. 12 and 13 of the European Regulation No. 679/2016? "General Regulation for the Protection of Personal Data", we are to provide you with information about the processing of your personal data.
We remind you that you have the right to view this Privacy Policy before disclosing your Personal Data to us, or to exercise your Right to object to one or more of the purposes (purposes) of processing indicated in this Privacy Policy in the relevant section.

The main processing carried out is related to the fulfillment of the contract with the customer and all the obligations related to it (both contractual, fiscal and operational), as well as the procurement of new customers and the increase in business volume through those already acquired.
The main risks associated with the above processing are identifiable in the possibility that one or more of the actions aimed at obtaining new business may violate the rights and freedoms of the data subject, for example, by annoying the data subject by receiving unwanted commercial offers. Motion S.p.A., however, takes all technical and organizational measures to ensure that those who receive its advertising or marketing offers have, in fact, given their consent. In addition, it will ensure that the frequency of sending and the manner in which it is sent do not exceed what is considered a lawful advertising activity.

In general, an identifiable risk is the possibility that unauthorized persons or third parties may come into contact with personal data of Data Subjects that Motion S.p.A. holds. However, in accordance with applicable law, Motion S.p.A. takes all appropriate technical and organizational measures to reduce the risk of such an event occurring to an acceptable minimum.
The purposes (purposes) for which we process Your Personal Data are as follows:
1) If Client of Motion S.p.A.: fulfillment of obligations related to the contract signed with the person concerned and all pre-contractual measures related to it, such as budgeting, negotiation, insertion in internal management etc.. and (if applicable) sending commercial communications. In this case, the consent is not required because the legal basis of the treatment is found in the contract signed with the person concerned and in all pre-contractual measures related to it, or in the legitimate interest of the owner of the treatment, as "there is a relevant and appropriate relationship with the person concerned?
2) If you are not a client of Motion S.p.A.: for the activity of finding new customers, such as sending commercial communications by e-mail, telephone, regular mail, etc.. In this case, consent is required and constitutes the legal basis for the processing itself.
Upon your request, we will provide you with a full list of the recipients with whom we may need to share your Personal Data in accordance with applicable laws. The request must be made to the Data Controller without any particular formality.
The Categories of Recipients to whom Your Personal Data will be disclosed are:
1) Companies and Professionals in charge of the management, maintenance and assistance of Motion S.p.A.'s IT system.
2) Professionals in the field of Accounting.
3) Companies that manage Motion S.p.A.'s web equipment.
4) Software Houses and Software Solution Manufacturers used by Motion S.p.A. to process Personal Data.
5) Public bodies such as the Inland Revenue, Guardia di Finanza etc.. Or public officials, if the communication of your Personal Data was a legal obligation.
(6) Banks, credit institutions, and insurance companies.
7) External consultants and professionals such as business agents, management consultants, business brokers.
All Recipients will (if applicable) be appointed as Managers and instructed by Motion S.p.A. in accordance with the provisions of the Law, as well as required to keep the information transmitted confidential and to delete or return it once the processing has been completed.
Motion S.p.A. does not and will not transfer Your Personal Data to international organizations or data controllers located outside the European Economic Area. If it decides to do so, it will scrupulously comply with the provisions dictated by EU Reg. 679/2016 on the foreign transfer of personal data and will take care to inform you, in accordance with the provisions of the Law, before making the transfer.
Motion S.p.A. will store your Personal Data according to these criteria:
1) In the case of Personal Data subject to storage obligations established by Italian or European Law: within and not beyond the limits dictated by the reference legislation, after which they will be deleted or made anonymous.
2) In the case of Personal Data of customers who are natural persons granted for the purposes (purposes) referred to in point 2) of the Purposes: until the interested party revokes his or her consent and in any case no later than 5 years from the consent given.
Below we will set out the Rights you enjoy under the European Regulation No. 679/2016. To exercise one or more of the following rights, simply contact Motion S.p.A. at the contacts indicated above without any particular formality.
The customer has the right to access personal data belonging to him held by the Company pursuant to art. 15 EU Reg. 679/2016.
Pursuant to art. 16 of the Regulation, the data subject has the right to obtain from the Data Controller the rectification of inaccurate personal data concerning him/her without undue delay.
The Data Subject has the right to obtain from the Data Controller the erasure of personal data concerning him/her and the Data Controller has the obligation to erase the personal data without undue delay, if the reasons indicated in art. 17 of the Regulation apply.
The interested party has the right to obtain from the Data Controller the limitation of the processing when the reasons indicated in art. 18 of the Regulation apply.
For the purposes (purposes) for which you have given your consent, you are guaranteed the right to revoke your consent, i.e. to withdraw unilaterally from processing related to the purposes for which you have given your consent.
If you believe that a processing carried out by us has caused you harm or damage, or if you believe that there have been improper or unlawful processing of your Personal Data, you are guaranteed the right to lodge a complaint with the Supervisory Authority, in accordance with the procedures indicated therein.
Your partial or complete refusal to provide Motion S.p.A. with your Personal Data will make it impossible to complete the execution of any contract.

The computer systems responsible for the functioning of this site acquire, during normal navigation, some personal data whose use is necessary for the proper functioning of Internet services (IP addresses, domain names of computers used by users who connect to the site, the time of the request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server, etc.) and other parameters regarding the operating system and computer environment.
These data are used only to obtain anonymous statistical information on the use of the site and to check its correct functioning. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site.

Optional supply of personal data

Apart from that specified for navigation data that are recorded automatically, the user is free to provide personal data (eg name, surname, address, email, ?) required in the forms on the site. Their lack of conferment may make it impossible to obtain what has been requested.

Rights of interested parties

The subjects whose personal data refer have the right at any time to obtain confirmation of the existence or otherwise of such data and to know its content and origin, verify its accuracy or request its integration or updating, or correction, cancellation, transformation into anonymous form or blocking of data processed unlawfully, and to oppose in any case, for legitimate reasons, to their treatment, pursuant to Article 7 and in accordance with the procedures laid down in Article 9 of Legislative Decree no. 196 of 30 June 2003.
